• The EPA classified Black Berkey Purification Elements as an unregistered "pesticide device" under U.S. federal law (FIFRA), because the elements contain silver used as an antimicrobial agent.
• This led the EPA to issue Stop-Sale, Use, or Removal Orders (SSUROs), halting production and distribution of genuine Black Berkey elements. Existing stock sold out through 2024, and standalone replacement elements have not been back in production since.
• Berkey's manufacturer, New Millennium Concepts Ltd. (NMCL), sued the EPA to challenge the classification. That case was initially dismissed on procedural jurisdiction grounds, and the appeal is still active before the Fifth Circuit Court of Appeals as of mid-2026. A related case, Berkey International v. EPA, is also ongoing, with oral arguments heard in late 2025. Neither case has reached a final ruling.
• A separate 2022 consumer class action alleges Berkey's marketing overstated what its filters could remove; no settlement has been confirmed as of this update.
• In late 2025, NMCL introduced "Phoenix" branded replacement elements as its own EPA-compliant option for existing Berkey housing owners, carrying NSF/ANSI 42 and 372 certification, though with a narrower set of contaminant reduction claims than the original Black Berkey elements.
